The Metaphysics of Gender is a book about gender essentialism: what it is and why it might be true.

The American conservative movement is a force of anti-reflexivity insofar as it attacks two key elements of reflexive modernization: the environmental movement and environmental impact science. Learning from its mistakes in overtly attacking environmental regulations in the early 1980s, this counter-movement has subsequently exercised a more subtle form of power characterized by non-decision-making. We examine the conservative movement’s efforts to undermine climate science and policy in the USA over the last two decades by using this second dimension of power. The (...) conservative movement has employed four non-decision-making techniques to challenge the legitimacy of climate science and prevent progress in policy-making. We argue that reflexive modernization scholars should focus more attention on similar forces of anti-reflexivity that continue to shape the overall direction of our social, political and economic order, and the life chances of many citizens. Indeed, better understanding of the forces and effectiveness of anti-reflexivity may very well be crucial for societal resilience and adaptation, especially in the face of global environmental problems like climate change. In Boltzmannian statistical mechanics macro-states supervene on micro-states. This leads to a partitioning of the state space of a system into regions of macroscopically indistinguishable micro-states. The largest of these regions is singled out as the equilibrium region of the system. What justifies this association? We review currently available answers to this question and find them wanting both for conceptual and for technical reasons. We propose a new conception of equilibrium and prove a mathematical theorem which establishes in full generality (...) -- i.e. without making any assumptions about the system's dynamics or the nature of the interactions between its components -- that the equilibrium macro-region is the largest macro-region. We then turn to the question of the approach to equilibrium, of which there exists no satisfactory general answer so far. In our account, this question is replaced by the question when an equilibrium state exists. We prove another -- again fully general -- theorem providing necessary and sufficient conditions for the existence of an equilibrium state. This theorem changes the way in which the question of the approach to equilibrium should be discussed: rather than launching a search for a crucial factor, the focus should be on finding triplets of macro-variables, dynamical conditions, and effective state spaces that satisfy the conditions of the theorem. A popular view in contemporary Boltzmannian statistical mechanics is to interpret the measures as typicality measures. In measure-theoretic dynamical systems theory measures can similarly be interpreted as typicality measures. However, a justification why these measures are a good choice of typicality measures is missing, and the paper attempts to fill this gap. The paper first argues that Pitowsky's (2012) justification of typicality measures does not fit the bill. Then a first proposal of how to justify typicality measures is presented. The (...) main premises are that typicality measures are invariant and are related to the initial probability distribution of interest (which are translation-continuous or translation-close). The conclusions are two theorems which show that the standard measures of statistical mechanics and dynamical systems are typicality measures. There may be other typicality measures, but they agree about judgements of typicality. Finally, it is proven that if systems are ergodic or epsilon-ergodic, there are uniqueness results about typicality measures. (shrink)

According to the Spatial Quantity Association of Response Codes (SQUARC), people hold a mental association between horizontal position and quantity (lower quantities left, higher quantities right). While a large body of research has explored this effect for response speed and judgment accuracy, the affective downstream consequences of the SQUARC remain unexplored. Aiming to address this gap, the present two experiments (pre-registered, total N = 521) investigated whether stimulus arrangements that are compatible with the SQUARC for luminance are affectively preferred to (...) stimulus arrangements that are incompatible. SQUARC-compatible square arrangements (dark-left, bright-right) were preferred over SQUARC-incompatible square arrangements (dark-right, bright-left). The preference for SQUARC compatibility was not moderated by the horizontal orientation of the response scale. Our results confirm the direction of the spatial-luminance association and provide initial support that the cognitive processing of SQUARC compatibility is hedonically marked and appears sufficient to impact affective evaluations. The aim of the article is to provide a clear and thorough conceptual analysis of the main candidates for a definition of climate and climate change. Five desiderata on a definition of climate are presented: it should be empirically applicable; it should correctly classify different climates; it should not depend on our knowledge; it should be applicable to the past, present, and future; and it should be mathematically well-defined. Then five definitions are discussed: climate as distribution over time for constant (...) external conditions; climate as distribution over time when the external conditions vary as in reality; climate as distribution over time relative to regimes of varying external conditions; climate as the ensemble distribution for constant external conditions; and climate as the ensemble distribution when the external conditions vary as in reality. The third definition is novel and is introduced as a response to problems with existing definitions. Hegel's Aesthetics is the first comprehensive interpretation of Hegel's philosophy of art in English in thirty years. It gives a new analysis of his notorious "end of art" thesis, shows the indispensability of his aesthetics to his philosophy generally, and argues for his theory's relevance today.

Many examples of calibration in climate science raise no alarms regarding model reliability. We examine one example and show that, in employing Classical Hypothesis-testing, it involves calibrating a base model against data that is also used to confirm the model. This is counter to the "intuitive position". We argue, however, that aspects of the intuitive position are upheld by some methods, in particular, the general Cross-validation method. There is a question that has not been raised in the literature on Japan's regionalism: Why does it have a strong tendency toward making the boundary of the proposed East Asian community fluid? By looking back beyond the Greater East Asia Co-Prosperity Sphere of the 1940s, a method hitherto untried, the paper shows that this Japanese propensity was also present in the first half of the twentieth century, especially in the 1920s and 1930s. Moreover, both then and now, Japan did (...) not and does not have a firm adherence to an ideology. These are two similarities between the pre-World War II period and the present (from the 1960s). On the other hand, Japan's present international situation is very different from its pre-World War II position. The paper uses the logic of the comparative method, which states that in two cases that are different in most aspects but the same in some, one or some of the similarities may explain the other similarity or similarities. It concludes that in both periods, the lack of a firm commitment to an ideology explains Japan's prejudice toward boundary fluidity. This explanation has the potential to contribute to a more comprehensive, if not yet a general theory of Japan's approach to regionalism because it applies not only to the present, but to the past as well. And it has to be stressed, the past refers not only to the Greater East Asia Co-Prosperity Sphere of the 1940s but also to the decades before. (shrink)

Our paper explores how the affective energies and cultural expectations set in motion by best-selling American sentimental novels like Hannah Foster's The Coquette and Susanna Rowson's Charlotte Temple informed the notorious mid-nineteenth-century American trial of Amelia Norman, who attempted to kill the man who seduced her. Once newspapers, defense lawyers, and reformers such as Lydia Maria Child recast the defendant as a sentimental heroine, the trial became about seduction, and Norman was acquitted against the weight of the evidence. (...) Sentimental novels turn on the contrast between the passive victim status of the heroine and the active libidinal quest of the rake-villain. As Cathy Davidson points out, this fiction is "about silence, subservience, stasis (the accepted attributes of women as traditionally defined) in contradistinction to conflicting impulses toward independence, action, and self expression (the ideals of the new American nation)." The seduction plot diverts attention from this disparity by establishing an affective solidarity between heroine and reader and elevating the ruined woman to a tragic status. The sentimental emplotment of Norman's life marshaled a powerful set of emotional responses and moral judgements on her behalf. Norman claimed insanity. And since sentimental heroines are supposed to go mad when they are seduced and abandoned, the jury was prepared to interpret her symptoms according to her lawyers' very strategy for establishing her innocence. Ultimately, however, Norman embodied the plight of the sentimental heroine at the same time that she contested her fictional counterpart's fate. In this way, her trial spectacularized the disparity which the sentimental novel conjures up and displaces but never resolves. The common law theory of coverture, which severely limited the legal personhood of married women, has received a great deal of scholarly attention. Cases like Norman's remind us that unmarried women were also subject to draconian constraints on their legal personhood. The tort of seduction is a key example. Legal historians trace the development of the seduction tort from its common-law origins, when men's property interest in women's bodies formed the basis of the cause of action, to 1851, when Field Code authors (including Norman's lawyer David Graham) persuaded several states to grant seduced women standing to bring their own cause of action. Consequently, courts were forced to reckon with the seduced woman as a moral agent capable of consenting to sex. As trials like Norman's demonstrate, sentimental novels helped lay the groundwork for this shift in the law by elucidating a subjectivity for the seduced woman. Yet the doctrinal implications of Norman's precedent-setting trial had a second, more ambiguous strain. Norman's sentimental strategy proved so powerful that men on trial for killing their wive's seducers appropriated it to bring their own stories before juries and to reinforce male sexual norms. In the end, then, Norman's trial fostered legal reform, but it also suggested - as Child's fictionalization of the case in "Rosenglory" recognized - that only sustained and multifaceted efforts to change cultural as well as legal norms could improve the sexual status of women. Scholars such as Wai Chee Dimock have argued for a focus "on the historical and historically shifting relations between law and literature" - a view we endorse. Where we differ from Dimock is in our diversion of attention away from abstract ideas of law laid out by treatise writers and philosophers in favor of law experienced and manipulated by individuals. So, too, we are interested less in representations of concepts such as justice in legal and literary texts than we are in the ways in which literature (broadly conceived) can create provisional and fragile opportunities for concrete instantiations of justice and even generate legal change (for good or ill). Going further, we would argue that to the extent legal change motivates rather than simply mirrors cultural change, it needs literature to be effective. Thus, we see no need to characterize - and indeed reject the depiction of - law as "a limited arena" in which ideas of morality have little place. This project, then, responds to Gregg Crane's call for attention to "the complex and slippery historical interactions of law and literature that shape and are shaped by an ever changing cultural idiom of justice." The extended story of Amelia Norman not only constitutes a case study in the inescapable interaction between the overlapping and interdependent discourses of law and literature, but also reveals the literary and legal consequences of that interaction. It can be shown that certain kinds of classical deterministic and indeterministic descriptions are observationally equivalent. Then the question arises: which description is preferable relative to evidence? This paper looks at the main argument in the literature for the deterministic description by Winnie (The cosmos of science—essays of exploration. Pittsburgh University Press, Pittsburgh, pp 299–324, 1998). It is shown that this argument yields the desired conclusion relative to in principle possible observations where there are no limits, in principle, on observational (...) accuracy. Yet relative to the currently possible observations (of relevance in practice), relative to the actual observations, or relative to in principle observations where there are limits, in principle, on observational accuracy the argument fails. Then Winnie’s analogy between his argument for the deterministic description and his argument against the prevalence of Bernoulli randomness in deterministic descriptions is considered. It is argued that while the arguments are indeed analogous, it is also important to see they are disanalogous in another sense. (shrink)

This article looks at the way the Brazilian writer and educator Nísia Floresta addresses issues of race and class within her construction of nationhood. This is achieved through a consideration of the specific subject of maternal breast-feeding as discussed by Floresta in two texts, written in Brazil and France, respectively. A comparison of these works reveals a very different engagement with race and class factors in determining women's claim to citizenship. Floresta, in common with early 19th-century European feminism, believed this (...) claim to lie within the domestic sphere, primarily in the role of mother and educator. The article considers how, as a vital aspect of that role, she portrays maternal breast-feeding as both natural and patriotic. It also highlights the extent to which Floresta was influenced by the prevailing concerns of her contemporaries regarding the risks of wet nursing and the threat posed by household slaves, before going on to consider how this discourse leads Floresta to exclude black slave women from her vision of patriotic motherhood, while acknowledging the maternity of women of all classes in a European context. Patriotic concerns, shaped by racial prejudices, overshadow Floresta's feminism, prohibiting the kind of unifying discourse of motherhood, which she claimed to profess. (shrink)

Towards the very end of his wide-ranging lectures on the philosophy of art, Hegel unexpectedly expresses a preference for comedy over tragedy. More surprisingly, given his systematic claims for his aesthetic theory, he suggests that this preference is arbitrary. This essay suggests that this arbitrariness is itself systematic, given Hegel’s broader claims about unity and necessity in art generally and his analysis of ancient as opposed to modern drama in particular. With the emergence of modern subjectivity, tragic plots lose their (...) necessity and so their redemptive conclusions; comic plots disintegrate into mockery and entertainment. In many cases, the dramas in question consequently fail to be art. This does not, however, mean that art ends: insofar as it inspires humans to a better understanding of their unity with the divine, it will continue to meet its mandate. But the lack of necessity in modern drama means we are free to prefer happy endings. Hegel’s seemingly arbitrary preference is, in the end, systematically justified. (shrink)

In his early and unpublished essay on Schiller’s trilogy Wallenstein, Hegel criticizes the plays’ denouement as “horrific” and “appalling” and for depicting the triumph of death over life. Why was the young Hegel’s response to Wallenstein so negative? To answer this question, I first offer an analysis of Wallenstein in terms of Hegel’s mature theory of modern tragedy. I argue that Schiller’s portrayal of Wallenstein’s character and death indeed render the play a particularly dark and unredemptive example of modern tragedy (...) as Hegel understands it. I suggest, however, that Hegel’s early objections are primarily motivated by his philosophy of history rather than by his theory of tragedy. Hegel accurately sensed the loss of faith in historical progress that Schiller experienced in the wake of the French Revolution; in essays written shortly before Wallenstein appeared, Schiller associates the tragic sublime with humans’ ability to act in the face of the meaninglessness of history. In his essay “The German Constitution,” composed during the same period as his Wallenstein review, Hegel instead formulates his familiar exhortation that we see history as meaningful. Hegel’s objection to Wallenstein’s darkness, then, is primarily an objection to the vision of history it portrays. Against the background of Peter Stein’s 2007 Berlin production of Wallenstein, I suggest that Wallenstein’s lasting appeal lies in its ability to allow audiences to experience the sublime as Schiller intended: as an assertion of our agency despite the cycles of history we so little control. In an examination of the psychological aspect of passing, this essay challenges Sandy Stone's conceptualization and subsequent request for transsexuals to forego the act. Employing an auto-ethnographical approach, this essay contends that considering the “psychic” dimensions of passing requires different, and more hopeful, articulations about transsexual bodies, such that gendered and racialized transsexual bodies are produced not simply in terms of social reading and physical embodiment, but also through psychic affirmation and disavowal.

In this paper we analyse how the risks associated with research on transgenic plants are regulated in Sweden. The paper outlines the way in which pilot projects in the plant sciences are overseen in Sweden, and discusses the international and national background to the current regulatory system. The historical, and hitherto unexplored, reasons for the evolution of current administrative and legislative procedures in plant science are of particular interest. Specifically, we discuss similarities and differences in the regulation of medicine and (...) plant science, and we examine the tendency towards dichotomizing risk — focusing on social/ethical risks in medicine and biological risks in plant science. The context of this article is the Synpraxia research project, an inter-disciplinary program combining expertise in sciences and the humanities. (shrink)

Christine Korsgaard attempts to reinterpret Kantian ethics in a way that might alleviate Bernard Williams’ famous worry that a man cannot save his drowning wife without determining impartially that he may do so. She does this by dividing a reflective self that chooses the commitments that make up an agent’s practical identity from a self defined as a jumble of desires. An agent, she then argues, must act on the commitments chosen by the reflective self on pain of disintegration. Using (...) Harry Frankfurt’s emphasis on love as a final end, I argue that disintegration as motivation is not a more acceptable motivation than impartiality and so does not adequately address Williams’ criticism. I also argue that the idea of a divided self either leads to an infinite regress or to an implausible description of how our commitments evolve and change. To make this last claim, I discuss a case from John Updike’s novel 'In the Beauty of the Lilies.'. (shrink)

Immanuel Kant's description of humans' first encounter with each other depicts a peaceful recognition of mutual worth. G.W.F. Hegel's by contrast depicts a struggle to the death. I argue in this paper that Hegel's description of conflict results in an ethical theory that better preserves the distinctness of the other. I consider Christine Korsgaard's description of first encounters as a third alternative but conclude that Hegel's approach better accounts for the specific commitments we make--as family members, works, and citizens --in (...) ethical life. Probability and indeterminism have always been core philosophical themes. This paper aims to contribute to understanding probability and indeterminism in biology. To provide the background for the paper, it will first be argued that an omniscient being would not need the probabilities of evolutionary theory to make predictions about biological processes. However, despite this, one can still be a realist about evolutionary theory, and then the probabilities in evolutionary theory refer to real features of the world. This prompts the question (...) of how to interpret biological probabilities which correspond to real features of the world but are in principle dispensable for predictive purposes. This paper will suggest three possible interpretations. The first interpretation is a propensity interpretation of kinds of systems. It will be argued that backward probabilities in biology do not present a problem for this propensity interpretation. The second interpretation is the frequency interpretation. Third, I will suggest Humean chances are a new interpretation of probability in evolutionary theory. Finally, this paper discusses Sansom’s argument that biological processes are indeterministic because probabilities in evolutionary theory refer to real features of the world. It will be argued that Sansom’s argument is not conclusive, and that the question whether biological processes are deterministic or indeterministic is still with us. (shrink)

While family forms are ever more diverse, there are few critical analyses of the ways in which LGBTQ families have been represented in fiction. This article explores recent Italian novels by Cristiana Alicata, Melania Mazzucco and Chiara Francini that depict lesbian and gay parents and their children. In all these novels at least one gay or lesbian parent dies. Drawing on Judith Butler’s work on mourning and melancholia, I problematize the persistent spectre of grief and loss attached to gay and (...) lesbian parenting. However, reflections by Heather Love also prompt me to explore what Love calls a “politics of damage”, or an attempt to see past the looming threat of inevitable homosexual doom towards the queer, subversive elements of these narratives, which question normative conceptions of the family and open up space to reflect on ‘alternative’ parental models.
